Terms of Service

These Terms of Service ("Terms") govern your use of the Messagram mobile application and related website services. By downloading, installing, or using Messagram, you agree to these Terms.

Important: Please add your full legal company name and postal address here before publishing. This is required for proper legal transparency in Germany and the EU.

2) Scope of service

Messagram is an Android application that helps forward selected phone events from your device to Telegram based on your configuration, including incoming SMS and missed call notifications. Features may vary by device, Android version, carrier, permissions, and Telegram availability.

3) Eligibility and account responsibility

You must be legally capable of entering into this agreement in your jurisdiction.
You are responsible for all activity performed through your device and your configured Telegram connection.
You must keep your device, Telegram account, and any connection code secure.

4) Permissions and device access

To provide core functionality, the app may request Android permissions, including:

RECEIVE_SMS: required to detect and forward incoming SMS.
READ_CALL_LOG: required for missed-call reporting.
READ_CONTACTS (optional): to resolve phone numbers into contact names.
READ_PHONE_NUMBERS / READ_PHONE_STATE (optional): to improve SIM identification on single/dual-SIM devices.

You can revoke permissions at any time in Android settings. Revoking required permissions may disable related functionality.

5) Lawful use and your responsibilities

You must use Messagram only for lawful purposes and in compliance with applicable telecom, privacy, employment, and criminal laws.
You are responsible for ensuring you are allowed to forward and process message/call content in your specific context (for example business, employment, or shared-device environments).
You must not use the service for stalking, harassment, unauthorized surveillance, fraud, spam, or any other unlawful activity.

6) Prohibited actions

Attempting to bypass app security, usage restrictions, or platform controls.
Reverse engineering, decompiling, or disassembling the app except where mandatory law expressly permits this.
Using the service to interfere with infrastructure, overload systems, or compromise integrity/security.

7) Third-party services

Messagram relies on third-party services and platforms, including Telegram and Google/Android infrastructure. Your use of those services is subject to their own terms and privacy notices. We are not responsible for third-party service outages, account actions, or policy decisions.

8) Privacy and data protection

Our processing of personal data is governed by our Privacy Policy: privacy.html. By using Messagram, you acknowledge that service delivery requires processing described there.

9) Availability, updates, and changes to functionality

We may update, improve, restrict, or discontinue features where reasonably necessary (for example for security, legal compliance, third-party API changes, or technical maintenance). We do not guarantee uninterrupted availability at all times.

10) Fees and costs

Unless explicitly stated otherwise in the app/store listing, Messagram is provided without recurring subscription fees. Your carrier/data charges and third-party messaging costs may still apply.

11) Intellectual property and license

Messagram and related content are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal or internal business use on compatible devices.

12) Suspension and termination

We may suspend or terminate access where required to address security risks, legal obligations, abuse, or material breaches of these Terms. You can stop using the app at any time and remove your data by uninstalling the app and clearing local app data.

13) Warranty and liability

Mandatory statutory rights remain unaffected.

We are fully liable for intent (Vorsatz) and gross negligence (grobe Fahrlassigkeit).
We are fully liable for damages resulting from injury to life, body, or health.
In cases of slight negligence, we are liable only for breach of essential contractual obligations (Kardinalpflichten), and liability is limited to foreseeable, typical damage.
Liability under mandatory product-liability law and other non-waivable statutory provisions remains unaffected.

Any additional liability limitations apply only to the extent permitted by applicable law.

14) Indemnification

You agree to indemnify and hold us harmless from third-party claims arising from your unlawful use of the service or your violation of these Terms, to the extent legally permissible.

15) Governing law and jurisdiction

For consumers in the EU/EEA, mandatory consumer protection rules of your country of habitual residence remain unaffected.

For businesses/merchants, these Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction is our registered seat.

16) Consumer dispute resolution (Germany/EU)

Information under Section 36 VSBG (Germany): We are not obliged and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

The EU Online Dispute Resolution (ODR) platform has been discontinued pursuant to Regulation (EU) 2024/3228. Complaint submissions were discontinued on March 20, 2025, and platform case data was deleted by July 20, 2025.

17) Changes to these Terms

We may amend these Terms where required for legal, security, or operational reasons. The then-current version will be published on this page with an updated "Last Updated" date.

18) Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law.
